16.3 Implied Warranty of Fitness

  1. Where the seller represents that a vehicle is fit for a particular purpose, or knows a buyer is buying a vehicle for a particular purpose, (ex. towing, hauling particular goods, etc.) such knowledge or representation may create an implied warranty of fitness for that particular purpose. Express Warranty

  1. An express written or oral agreement by the dealer to warrant, or guarantee, some condition of the vehicle for sale. [California Commercial Code]
